Liability Disclaimer Third Party Rights
Dear Customer,
Unless expressly agreed otherwise, I will also take photographs of third parties during your commissioned photo shoot. In doing so, I intervene in their personal rights and process personal data through the image recordings.
Since I am acting on your behalf, you are responsible for ensuring that these persons consent to this. This also applies to objects photographed on site. You need consent from both the rights holders (for object photographs) and for photographs of persons.
While guests generally expect weddings to be photographically documented by or for the bride and groom, it is advisable to inform the attending guests as well as other persons present (e.g., catering service, wedding officiant, DJ) about this.
Should any person present not agree to being photographed, please inform me so that I can respect this wish. For group photos, such a person should not be part of the group. Please ensure this as well.
If you do not appropriately inform the persons present or rights holders of objects and obtain their consent, you assume liability for all claims made against me as a result.
Please also note that you must obtain consent to photograph in the respective celebration venues and outdoor areas. Otherwise, the authorized party would have the option to prevent me from taking photographs. This would be a case of contract termination that I would not be responsible for, meaning you would still be required to pay the full fee.
Upon your request, I can display a notice on site that comprehensively informs about rights under applicable data protection law. However, if I do so, this does not release you from the above-mentioned indemnification, but merely represents non-binding assistance on my part.
